The Trade Act

The Trade (Restriction on Importation) (Chlorofluorocarbons) (Amendment) Order, 2002

In exercise of the power conferred on the Minister by section 8 (1_ (b) of the Trade Act and every other power hereunto enabling, the following Order is hereby made: -

1. This Order may be cited as The Trade (Restriction on Importation) (Chlorofluorocarbons) (Amendment) Order, 2002 and shall be read and construed as one with the Trade (Restriction on Importation) (Chlorofluorocarbons) Order, 1999, hereinafter referred to as the principal Order.

2. The principal Order is amended by inserting next after paragraph 6 the following as paragraphs 7,8 and 9 -

"7. -    (1) The sale by a company of its quota allocation or part thereof is prohibited. 

(2) A company that contravenes sub-paragraph (1) is liable, in addition to the penalty specified in section 10 (1) (c) of the Act, to a reduction in its quota allocation.

8. Where there is a change in the status of a company specified in Part I of the Schedule that a company shall notify the Natural Resources Conservation Authority and the Trade Board of such change.

9. Where a company goes out of business the Minister may, after consultation with the Natural Resources Conservation Authority --

(a) reallocate that company's quota to another company specified in Part I of the schedule; or

(b) cause that company's quota to be held in abeyance for emergency purposes.".

3. The Schedule to the principal Order is amended -

(a) by deleting the words "(paragraph 4)" and substituting therefor the words "(Paragraphs 2,3,4,8 and 9)";

(b) in Part I -

(i) by deleting from the second column the numerals "9.3" where they first appear and substituting therefor the numerals "16.6";

(ii) by deleting the following companies and their allocation -

"Victor Chang Ltd......................................................7.3";

"Alcan (Ja.) Co. Ltd...................................................7.3;

"Conditionedaire and Associates Constractors Ltd.......7.3;

(iii) by inserting therein in the appropriate columns the following -

"Windalco..............................................................7.3

"CAC 2000............................................................7.3;

(c) in Part II by deleting from the second column the follo\wing letters and numerals -

"R502 (51.2% CFC 115 and 48.8%) HCFC 22", and substituting therefor the following -

"R502 (512% CFC AND 48.8%) HCF22)".
